1. Acceptance of Terms

By accessing and using OVOSIM’s eSIM services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use this service. These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and Pinocchio, LLC, operating under the name OVOSIM (“Company,” “we,” “us,” or “our”).

2. Definitions

• eSIM: An embedded SIM card enabling mobile connectivity without a physical SIM.
• Profile: The digital SIM profile downloaded to your eSIM-compatible device.
• Data Package: A predefined amount of data valid for a certain period and region.
• Device: Any eSIM-enabled mobile phone, tablet, or IoT device.
• Service: OVOSIM’s eSIM provisioning, connectivity, and support services.
• Network Partner: Third-party network operators providing coverage.

3. Service Description

OVOSIM provides international eSIM connectivity including:

• eSIM profile provisioning and activation
• Data connectivity in supported countries
• QR code generation for installation
• Technical support and customer assistance
• Account and data usage management

Services are provided “as-is” and may vary depending on location, device compatibility, and local network availability.

4. Device Compatibility & Requirements

• Unlocked, eSIM-compatible device
• Stable internet connection for setup
• Support for regional frequency bands
• Updated software supporting eSIM tech

Users are responsible for confirming device compatibility prior to purchase. No refunds will be issued for incompatible devices.

5. Payment Terms & Refund Policy

Payments must be completed upfront via accepted payment methods. All amounts are displayed in USD unless otherwise stated.

Refunds

• Refunds within 7 days if eSIM not activated
• No refunds after QR scan or activation
• No refunds for partially used data
• Refunds processed to original method within 5–10 business days

6. Data Usage Policy

Fair Use

• Data is for personal, non-commercial use
• Abuse may lead to throttling or suspension
• No tethering or resale unless permitted
• Continuous streaming or torrenting prohibited

Validity

Data expires at the end of the validity period. Unused data cannot be extended or refunded.

7. Service Availability

Service availability may vary due to network conditions, geography, weather, or regulatory restrictions. OVOSIM does not guarantee uninterrupted service or speed.

8. Compliance & Restrictions

OVOSIM complies with international telecom laws and export regulations. Services may be restricted in countries under sanctions or export control laws.

9. Intellectual Property

All OVOSIM materials and technologies are protected by IP laws. Users may not reproduce, modify, or distribute without authorization.

10. User Responsibilities

• No illegal or fraudulent use
• No hacking or reverse engineering
• No resale of eSIMs or credentials
• No interference with service or users

11. Privacy & Data Protection

User data is handled in accordance with our Privacy Policy. We comply with GDPR, CCPA, and similar frameworks.

12. Limitation of Liability

OVOSIM is not liable for indirect or consequential damages, including loss of profit or data. Liability is limited to the service cost paid.

13. Indemnification

You agree to indemnify OVOSIM against claims resulting from your use of our services or violation of these Terms.

14. Force Majeure

OVOSIM shall not be held liable for service interruptions caused by events beyond its control, such as natural disasters or regulatory actions.

15. Governing Law & Dispute Resolution

These Terms are governed by Delaware law, U.S.A. Any disputes will be resolved through binding arbitration per the American Arbitration Association.

16. Modifications

OVOSIM reserves the right to modify these Terms with notice at least 30 days prior to enforcement. Continued use of the service constitutes acceptance.

17. Termination

OVOSIM may suspend or terminate services for violation of these Terms. Users may close accounts at any time; no refunds will be issued for unused data.
